1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Customer," "you") and BORA Bros ("we," "us," or "our"), concerning your access to and use of our Voice AI services (the "Service"). By using the Service, you agree to be bound by these Terms.
2. Service Description
BORA Bros provides an AI-powered "Intelligent Front Desk" that handles inbound phone calls for hospitality businesses. The Service can answer guest questions, check room availability, quote prices, and facilitate booking reservations by processing payments through a third-party service.
3. Customer Accounts and Responsibilities
The "Customer" is defined as the hotel, motel, or other lodging entity that subscribes to our Service. The Customer is responsible for maintaining the confidentiality of its account information and for all activities that occur under its account. The Customer is also responsible for the accuracy of information provided to the system, such as room rates, availability, and policies, which the AI will use to interact with guests.
4. Fees and Payment
The Customer agrees to pay all applicable fees for the Service as specified in their subscription plan. Subscriptions are billed in advance on a monthly or annual basis and are non-refundable. All fees are exclusive of taxes. Transaction fees associated with payments made by guests for bookings are determined and handled by our designated third-party payment processor (e.g., Stripe) and are separate from BORA Bros' subscription fees.
5. Legal Compliance (TCPA)
BORA Bros provides the technology to record calls and send SMS/email communications. However, the Customer is solely responsible for complying with all applicable laws and regulations regarding communications, including the Telephone Consumer Protection Act (TCPA) and state-specific call recording laws.
The Customer represents and warrants that it has obtained all necessary consents from individuals to: (a) record inbound and outbound phone calls; and (b) send transactional and informational text messages and emails. The Customer agrees to indemnify and hold harmless BORA Bros from any claims, damages, or liabilities arising from the Customer's failure to obtain such consent.
6. Service Accuracy and Limitation of Liability
BORA Bros strives for the highest level of accuracy in its AI-driven voice recognition, transcription, and responses. However, due to the nature of artificial intelligence, the Service may occasionally produce errors, inaccuracies, or "hallucinations" (generating plausible but incorrect information). BORA Bros shall not be held liable for any damages, financial or otherwise, arising from minor transcription errors, misunderstandings by the AI, or other inaccuracies in the information provided by the Service. Our liability is limited to the amount paid by the Customer for the Service in the preceding three (3) months.
7. Intellectual Property
BORA Bros retains all right, title, and interest in and to the Service, including all underlying AI models, software, technology, and associated intellectual property. The Customer retains all right, title, and interest in and to its own data, including guest information, booking records, and other proprietary business information ("Customer Data"). We are granted a limited license to use Customer Data solely for the purpose of providing and improving the Service.
8. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties. The Customer may cancel their subscription at any time, but no refunds will be provided for any prepaid fees.
9. Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
